How to get out of a speeding ticket
Speeding
fines and tickets are put in place to deter drivers from exceeding the speed limits
and are used to punish motorists for breaking the law. We have all heard old wife’s
tales of how to get out of them but thanks to some useful insights, we have
created a guide to appealing and winning.
Currently,
if you breach a speed limit then rightfully you will be handed a fine, penalty
points and in some cases you could lose your license.
We’ve all
seen them, a multitude of cameras are now in force across the country which work
in different ways to encourage drivers to slow down and avoid breaking the
speed limit.
As there
are so many variations of speeding to consider, motorists have a few defenses
that could help them get out of a spot of bother. In this article we also look at
the simple loophole that drivers can use to get out of a ticket.
Once you
commit an offence you can expect to receive a ‘notice of intended prosecution’
or an NIP which is a quick form that asks you to confirm the driver of the
vehicle involved in the incident.
You are given
a short time frame in which you are required to respond. If you fail to send correspondence
within that time period then expect to be hit with a fine of £100.
As the
driver, you are expected to receive the NIP within 14 days of when the speeding
offence took place. If you didn’t receive it during that time then it is your right
to reject the punishment. Under the Road Traffic Act 1998, the NIP must be sent
to the registered keeper of the vehicle within the 14 day time frame.
Other defenses
for a speeding ticket that you may also be interested to learn about is if the
date, time or location of the speeding offence is incorrect. You must return
the NIP with the relevant information as quickly as possible to increase your
chances of a successful appeal.
These are the top 5 appeals against a speeding
fine:
- Your
car was stolen
- There
wasn’t proper notice of the speed limit
- It
wasn’t you driving when the speeding offence happened
- The speeding vehicle caught on camera has been misidentified
- You weren’t speeding
If you are
planning of defending yourself and appealing an offence, make sure that you
have suitable evidence to back up your claim.
